Early Life and Education

Brian S. Lyda, Sr. was born in New York, NY, and has cultivated a diverse and accomplished career in both law and real estate. An Eagle Scout from the Middle Tennessee Council, he graduated from Tullahoma High School and went on to study biomedical engineering at Boston University’s School of Engineering, earning his Bachelor of Science degree in 1994.

Mr. Lyda furthered his education by obtaining a Juris Doctorate from Albany Law School at Union University and a technical MBA from Rensselaer Polytechnic Institute in May 2000 through a joint-degree program. His academic pursuits earned him honors in business law and estate planning, and he was awarded the Herbert E. Cohen Prize for demonstrating exceptional potential in corporate law and taxation.

Additionally, during his time at Albany Law School, Mr. Lyda served as the executive editor of the Albany Law Journal of Science & Technology, where he published an article titled “The Y2K Problem and Director Liability: Does the Business Judgment Rule Apply?”

Real Estate Career

In 2015, Mr. Lyda established Prime Listings, Inc., a residential and commercial real estate brokerage. As the principal real estate broker, he manages a team of four licensed salespersons, guiding clients through various transactions involving buying, selling, and investing in properties. His expertise expanded in 2022 when he became a licensed salesperson in Vermont, working with Perrott Realty in Bennington, Vermont.

Mr. Lyda actively participates in several professional associations, including the Greater Capital Association of Realtors (CGAR; Global MLS), New York State Association of REALTORS (NYSAR), Vermont Association of REALTORS, and the Commercial Industrial Real Estate Brokers Association (CIREB).

Legal Practice and Admissions

Mr. Lyda is admitted to practice law in all courts of New York State, the Commonwealth of Massachusetts, and the State of Florida (inactive status). He is also admitted to practice before the U.S. District Court for the Northern District of New York, the Southern District of Florida, the U.S. Bankruptcy Court for the Northern District of New York, the U.S. Court of Appeals for the Second Circuit, and the U.S. Supreme Court.

His professional memberships include the New York State Bar Association (NYSBA), Massachusetts Bar Association (MBA), and The Florida Bar.

Current Role at Morgan Legal Group

In August 2023, Mr. Lyda joined Morgan Legal Group, P.C., where he focuses on guardianship and estate litigation matters. He provides comprehensive legal services related to succession planning for closely-held and family-owned businesses, advising clients on tax strategies, exit strategies, asset protection, and buy-sell agreements.

His practice also includes elder law and estate planning, with a particular emphasis on Medicaid planning, drafting asset protection trusts for Medicaid eligibility, and creating pooled supplemental needs trusts to maximize inheritance for beneficiaries.

Mr. Lyda frequently represents clients in Surrogate’s Courts in probate and administration proceedings, guardianship cases, and related matters. Additionally, his legal expertise extends to real estate advisory, civil and commercial litigation, construction and lien law, contract and lease review, real estate development, tax certiorari, and landlord/tenant law. He currently serves as the attorney for the Town of Hoosick Planning Board.
